These Terms of Service (the "Terms") are a legally binding agreement between you and SparkL ("SparkL", "we", "us", or "our"). They govern your access to and use of the SparkL website, applications, document viewer, practice tools, community, subscriptions, and related services (collectively, the "Service").
By creating an account, clicking to accept these Terms, purchasing a subscription, starting a trial, uploading content, or using the Service, you agree to these Terms and to our Privacy Policy, which is incorporated into them. If you do not agree, do not use the Service.
If you use SparkL on behalf of a school, club, or other organisation, you represent that you have authority to bind that organisation. References to "you" include that organisation.
SparkL is a student learning and community platform. Depending on your account, plan, and available content, the Service may include:
Features, content, plans, limits, and supported institutions may change over time. SparkL is not a school, university, polytechnic, examining body, lecturer, tutor, legal adviser, or academic authority. SparkL is not affiliated with or endorsed by any institution unless we expressly state otherwise in writing.
The Service is intended for students, staff, and prospective students of tertiary institutions. You must provide accurate information when creating an account and keep it current.
You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Contact us promptly through the support channel in your account settings if you suspect unauthorised access.
Do not create an account for another person without permission, impersonate another student or institution, or create multiple accounts to evade limits, bans, payment obligations, or moderation.
Free access may include up to three (3) unlocked courses and up to ten (10) readable or practice questions per unlocked course, or other limits shown in the Service. Community access is intended to remain available to all registered users, subject to reasonable anti-spam and safety limits. Free limits may vary by product version and may be changed with reasonable notice.

The exact features, limits, price, billing period, and currency will be shown at checkout or on the current pricing page. A plan description is part of these Terms for the period in which you purchase it.
Prices are shown in Nigerian Naira (₦) and may include or exclude applicable taxes as indicated at checkout. You are responsible for charges displayed before confirmation. We may change prices for future billing periods by giving notice required by law. A price change will not retroactively affect a completed purchase.
Payments are processed by a third-party payment provider. SparkL does not ordinarily store complete card details. The processor may collect and process payment information under its own terms and privacy notice. You authorise the payment provider to charge the selected plan using the payment method you provide.
Where offered, a new eligible account may receive one seven (7) day Premium trial. The trial may begin when you start a qualifying study action, such as opening full content or starting practice, as shown in the Service.

A subscription renews only as disclosed at checkout. If it auto-renews, you may cancel future renewal through your account settings before the renewal date. Cancellation stops the next charge but does not automatically refund the already-paid period; mandatory consumer rights are not affected. After cancellation, paid features remain available until the end of the current paid period unless access is suspended for a serious breach.
Refund eligibility is shown at checkout and is subject to applicable consumer law and the payment provider's procedures. Unless required otherwise by law, payments for a started billing period are non-refundable except where SparkL agrees in writing. See our Refund & Cancellation Policy for full details.
SparkL may display past questions and resources through a protected in-platform viewer. We may render pages as images, apply user-specific watermarks, limit page requests, or provide only selected content. Unless SparkL expressly provides a download or licence:

"User Content" means questions, answers, comments, images, files, documents, profile information, reviews, and other material you submit through SparkL.
You retain ownership of User Content to the extent you own it. You represent and warrant that:
You grant SparkL a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, format, OCR, index, display, watermark, moderate, and distribute your User Content as necessary to operate, improve, and secure the Service. This licence continues for as long as necessary for those purposes, subject to deletion obligations.
SparkL respects copyright and intellectual-property rights. Past examination papers may belong to an institution, examiner, publisher, or other rights holder. Do not upload a paper unless you have the necessary permission or a lawful basis.

We may remove or restrict access while investigating, contact the uploader, request evidence, preserve relevant records, and restore content where a complaint is not substantiated. Repeat infringers may have their accounts terminated. False or abusive complaints may result in account action.
The SparkL name, logo, software, user interface, design, compilation, databases, and non-user content are owned by or licensed to SparkL. Subject to these Terms, SparkL grants you a limited, personal, non-exclusive, non-transferable, revocable licence to access and use the Service for your own lawful education.
You may not copy, modify, sell, sublicense, reverse engineer, frame, republish, create a competing database, or commercially exploit SparkL except with written permission.
The community is intended to be available to free and paid users. When posting, choose the correct institution, programme, level, semester, and course where possible. Do not reveal examination secrets, private student records, phone numbers, matriculation numbers, passwords, payment details, or another person's personal information.
SparkL may label, restrict visibility, remove, edit for formatting, preserve, or disclose content where reasonably necessary for safety, legal compliance, rights protection, or operation of the Service. We do not guarantee that all harmful, inaccurate, or unlawful material will be detected.
SparkL may link to or integrate with payment providers, analytics tools, cloud storage, identity providers, or other services. Those services are governed by their own terms and policies. SparkL is not responsible for third-party content, availability, security, or practices.
The Service may be unavailable because of maintenance, connectivity, outages, security events, or circumstances beyond our control. We may add, remove, suspend, or modify features, content, institutions, or plans. We will use reasonable efforts to avoid material disruption and give notice where required.
Some features may be labelled beta, preview, or early access. They may be incomplete and may change or end without the same commitments as generally available features.
Past questions and materials on SparkL are user-submitted and provided for study and revision purposes only. SparkL does not guarantee the accuracy, completeness, or currency of any content. Past questions may not reflect the actual questions used in any current or future examination. SparkL is not affiliated with, endorsed by, or acting on behalf of any tertiary institution or examination body unless explicitly stated.
To the maximum extent permitted by law, the Service is provided "as is" and "as available" without warranties of any kind. We do not guarantee that the Service will be uninterrupted, error-free, or that any content will lead to particular academic results. SparkL is a study aid, not a substitute for official institutional instructions or professional advice.
You may stop using SparkL and request account deletion as described in our Privacy Policy. We may suspend or terminate access, remove content, cancel a trial, or restrict features if you violate these Terms, create risk, fail to pay, abuse a trial, infringe rights, threaten safety, or where required by law.
Where reasonably appropriate, we will provide notice and an opportunity to appeal. We may act immediately for serious abuse, fraud, security risks, illegal content, examination integrity issues, or legal requirements. On termination, your licence to use the Service ends. Provisions that by their nature should survive termination — including payment obligations, intellectual property, user-content licences, disclaimers, limitations, and enforcement rights — survive.
Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited, including liability for fraud, wilful misconduct, or death or personal injury caused by negligence.
Subject to that, to the maximum extent permitted by law, SparkL and its officers, employees, contractors, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive loss, or for loss of data, profits, goodwill, opportunity, or academic results.
SparkL's total aggregate liability arising from the Service will not exceed the greater of (a) the amount you paid to SparkL for the affected Service during the six months before the event giving rise to the claim, or (b) five thousand Naira (₦5,000).
To the extent permitted by law, you agree to defend, indemnify, and hold harmless SparkL and its officers, employees, contractors, licensors, and service providers from claims, losses, liabilities, costs, and reasonable expenses arising from your User Content, misuse of the Service, violation of these Terms, infringement of another person's rights, or violation of law.
If you have a complaint, please contact us through the support channel in your account settings so we can try to resolve the matter informally. These Terms are governed by the laws of the Federal Republic of Nigeria. Courts located in Nigeria will have jurisdiction, subject to any mandatory consumer or data-protection rights.
We may notify you by email, in-app notice, or a notice posted on the Service. You must keep your contact details current.
You may not assign these Terms without our written consent. SparkL may assign them in connection with a merger, acquisition, or transfer of the Service.
If any provision is held invalid, it will be modified to the minimum extent necessary and the remaining provisions will continue in full force. A failure to enforce a provision is not a waiver. These Terms, the Privacy Policy, and any plan-specific checkout terms form the entire agreement about the Service.
We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms. We will post the updated version with a new "Last updated" date and provide additional notice for material changes where required.
